1. Acceptance of Terms
By accessing or using any part of thednsnexus.com (the "Site") or any service provided by DNSnexus (the "Services"), you confirm that you are at least 13 years of age (or 16 in the EEA/UK), have read and understood these Terms, and agree to be bound by them.
If you are using the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Site and Services.
2. Description of Services
DNSnexus provides online diagnostic and informational tools including, but not limited to: DNS propagation checks, DNS record lookups, SSL/TLS certificate analysis, email authentication checks (SPF, DKIM, DMARC), IP geolocation and ASN lookups, port scanning, WHOIS queries, network diagnostics, and domain monitoring ("Tools").
The Tools are provided for informational and diagnostic purposes only. Results are best-effort snapshots of publicly accessible infrastructure data. They do not constitute professional advice (legal, security, technical, or otherwise) and should not be relied upon as such for critical business decisions without independent verification.
DNSnexus reserves the right to modify, suspend, or discontinue any Service, feature, or tool at any time without prior notice or liability.
3. Account Registration (Monitor)
Certain features (the Monitor dashboard) require account registration. When registering, you agree to:
- Provide accurate and current information
- Maintain the security of your password and not share account credentials
- Notify us immediately of any unauthorized account access at legal@thednsnexus.com
- Accept responsibility for all activity that occurs under your account
- Monitor only domains you own or are explicitly authorized to monitor
We reserve the right to refuse registration, suspend, or terminate accounts in our sole discretion, including for violation of these Terms.
4. Acceptable Use
You may use the Services solely for lawful purposes. Permitted uses include:
- Diagnosing DNS, email, SSL, and network configuration issues for domains and systems you own or are authorized to administer
- Verifying public infrastructure data for legitimate research, journalism, or educational purposes
- Security assessment of your own infrastructure or that of a client, with explicit written authorization
- Development and testing using the API (subject to rate limits and API Terms)
5. Prohibited Conduct
The following actions are strictly prohibited and may result in immediate account termination and/or legal action:
- Querying or scanning domains, IPs, or systems you do not own and have no authorization to test
- Using the Services for denial-of-service (DoS/DDoS) attacks, network flooding, or to degrade the availability of third-party systems
- Automated mass scraping of the Site or API without a written license agreement
- Circumventing rate limits, access controls, authentication mechanisms, or other technical safeguards
- Submitting false, misleading, or fraudulent inputs to manipulate tool results
- Reselling, white-labeling, or redistributing DNSnexus tool results or UI without express written permission
- Using the Services to process, store, or transmit malware, viruses, or other malicious code
- Impersonating any person or entity, or misrepresenting your affiliation with DNSnexus
- Harvesting user data from the Site or using the Services in any manner that violates any applicable law or regulation
- Accessing the Services with the intent to build a competing product or service
6. Intellectual Property
All content on the Site, including but not limited to the DNSnexus name, brand marks, logos, tool designs, UI/UX, source code, guides, documentation, and educational content, is the exclusive intellectual property of DNSnexus and its licensors, protected by copyright, trademark, and other applicable laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal or internal business use in accordance with these Terms. This license does not include any right to:
- Reproduce, distribute, or publicly display DNSnexus content commercially
- Modify, create derivative works from, or reverse engineer any part of the Services
- Use DNSnexus trademarks, logos, or branding without written permission
- Remove any proprietary notices from content obtained through the Services
Tool results reflecting publicly accessible DNS, WHOIS, or network data are factual outputs and not copyrighted. The presentation, layout, and surrounding content remain our property.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, DNSnexus expressly disclaims all warranties, including:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Services will be uninterrupted, error-free, secure, or free of viruses or harmful components
- Any warranty that tool results are accurate, complete, current, or reliable for any specific purpose
- Any warranty regarding the accuracy of DNS propagation data, which may vary by resolver, geography, and cache state
You assume all risk associated with your use of the Services. You are solely responsible for validating tool outputs before making infrastructure, security, or business decisions.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DNSNEXUS, ITS OPERATORS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunities
- Costs of substitute services
- Damages arising from your reliance on inaccurate tool results
- Damages resulting from service interruption, security breach, or data loss
arising out of or in connection with your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising under these Terms shall not exceed the greater of (a) the total fees paid by you to DNSnexus in the 12 months preceding the claim, or (b) USD $50. Some jurisdictions do not allow limitation of liability for certain damages, so these limitations may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless DNSnexus and its affiliates, operators, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property rights or privacy rights; (d) your violation of any applicable law or regulation; or (e) any content or data you submit to the Services, including inputs used in diagnostic tools.
10. Termination
DNSnexus may suspend or terminate your access to the Services — including your account, if any — at any time and without prior notice if we reasonably believe you have violated these Terms, engaged in abusive behavior, or if required by law.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Services ceases immediately.
Sections 6 (Intellectual Property), 7 (Disclaimer), 8 (Limitation of Liability), 9 (Indemnification), and 12 (Governing Law) survive any termination of these Terms.
11. Fees & Payment
Core diagnostic tools on DNSnexus are free to use. Certain advanced features (such as unlimited Monitor domains, higher rate limits, or API access) may require a paid subscription. For paid plans:
- All fees are stated in USD and are non-refundable unless required by law
- Subscription fees are billed in advance on a monthly or annual basis
- We reserve the right to change pricing with 30 days' notice to active subscribers
- Failure to pay may result in downgrade to the free tier or account suspension
- Taxes, if applicable, are the responsibility of the subscriber
12. Governing Law
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the jurisdiction in which DNSnexus is operated, without regard to conflict-of-law principles.
Nothing in these Terms limits your rights under mandatory applicable laws in your country of residence, including consumer protection rights that cannot be waived by contract.
13. Dispute Resolution
We prefer to resolve disputes informally. Before filing any formal legal claim, please contact us at legal@thednsnexus.com with a written description of the dispute. We will attempt to resolve it within 30 days.
If informal resolution fails, you and DNSnexus agree that any dispute shall be resolved by binding individual arbitration — not in a class action or class arbitration. Each party shall bear its own legal costs unless the arbitrator finds a claim was frivolous. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction for urgent matters involving intellectual property infringement or unauthorized access.
14. Changes to Terms
We reserve the right to update these Terms at any time. When we make material changes, we will update the "Last Updated" date and, where practical, notify registered users by email at least 14 days before changes take effect. Your continued use of the Services after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree, you must stop using the Services before the effective date.
15. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and DNSnexus regarding the Services and supersede all prior agreements.
Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights freely.
Force Majeure. DNSnexus is not liable for any failure or delay resulting from causes beyond our reasonable control, including natural disasters, internet disruptions, government actions, or third-party service failures.
Language. These Terms are provided in English. If translated, the English version controls in the event of any conflict.
